If the conjunctive I is identical to the present form of the indicative (which happens quite often) the conjunctive II is used instead of the conjunctive I.

  Have a look at this example
Er sagt: "Wir haben keine Lust." He says: "We don't feel like it."

Transformation with conjunctive I Transformation with conjunctive II
  Er sagt, dass wir keine Lust haben.   Er sagt, dass wir keine Lust hätten.  

Have you noticed? The conjunctive I is identical with present form of indicative mode.
